Credit: Debt Collector Calling

Debt collectors have to follow guidelines as to what they inform you of when they call you. For example, during the conversation, it is mandatory that the collector let you know that they are from a collection agency, that they are calling to collect debt, and that any information you provide will help them collect that debt. Furthermore, the collector has to let you know the name of the original creditor and the amount of money the collector is trying to get from you. The reason it is so important the caller inform you of these things is that it is how you will decide if it is a legitimate bill or not. Consider this: the caller does not inform you appropriately and you end up paying a disputable bill, an erroneous bill, or too much of a bill. It is illegal for the collection agency to collect more money than you owe, unless a law regarding the situation specifically states otherwise. In addition, these agencies cannot deposit a post-dated check before the date that is listed on the check to further keep you protected for any complications such an action may cause.

A debt collector, though permitted to call, cannot call repeatedly. This means that if you ask a collector not to call you at work, then these calls must end. Callers cannot threaten you with any sort of violence, seizing of your assets, or imprisonment, and are not allowed to use distasteful language. This involves cursing at you, ridiculing you, or making derogatory statements based on race, gender, sex, religion, or any other discriminatory verbal abuse. The callers also have specific time periods during which they can call you, ranging from 8 a.m. to 9 p.m. according to your time zone.
